Excluded: All office clerical employees, managers, guards and professional employees and supervisors as defined in the Act. Others permitted to vote: The parties have agreed that Clinical Educator Specialists may vote in the election but their ballots will be challenged since their eligibility has not been resolved. No decision has been made regarding whether the individuals in these classifications or groups are included in, or excluded from, the bargaining unit. The eligibility or inclusion of these individuals will be resolved, if necessary, following the election.

Excluded: All office clerical employees, professional employees, sales representatives, managerial employees, owners and children and spouses of majority shareholders of the company, guards and supervisors as defined in the Act, and all other employees.

Voting Unit (Unit A): INCLUDED: All full-time, regular part-time and per diem biomed techs and biomed engineering coordinators employed by the Employer at its facility currently located 17100 Euclid Street, Fountain Valley, California. Also eligible to vote are all employees in the unit who have worked an average of 4 hours or more per week during the 13 weeks immediately preceding the eligibility date for the election. EXCLUDED: All other employees, physicians, registered nurses, other professional employees, other skilled maintenance employees, other technical employees, business office clerical employees, guards, other non-professional employees, confidential employees, managerial employees, and supervisors as defined in the Act. If a majority of valid ballots are cast for NATIONAL UNION OF HEALTHCARE WORKERS (NUHW), they will be taken to have indicated the employees’ desire to be included in the existing Maintenance, Skilled Maintenance and Technical unit currently represented by NATIONAL UNION OF HEALTHCARE WORKERS (NUHW). If a majority of valid ballots are not cast for representation, they will be taken to have indicated the employees’ desire to remain unrepresented.

Voting Unit (Unit A): All full-time and regular part-time baristas and shift supervisors employed by the Employer at its facility currently located at 3046 Gate House Plaza, Falls Church, Virginia, but excluding all office clerical employees, guards, professional employees, and supervisors as defined in the Act. However, assistant store managers are neither included in nor excluded from the bargaining unit covered by this certification, inasmuch as the parties did not agree on the inclusion or exclusion of these classifications but agreed to vote them subject to challenge and resolution of their inclusion or exclusion was unnecessary because, in the circumstances of this case, their ballots were not determinative of the election results.
