Established in 1935, the National Labor Relations Board is an independent federal agency that protects employees, employers, and unions from unfair labor practices and protects the right of private sector employees to join together, with or without a union, to improve wages, benefits and working conditions. The NLRB conducts hundreds of workplace elections and investigates thousands of unfair labor practice charges each year. Margaret Diaz appointed Regional Director of NLRB's Tampa, FL Regional Office

NLRB Chairman Mark Gaston Pearce and Acting General Counsel Lafe E. Solomon have announced the appointment of Margaret J. Diaz as Regional Director in the Tampa Regional Office (Region 12).  Ms. Diaz will be responsible for enforcement of the nation’s primary labor law covering private sector employees in the State of Florida (except for 12 western counties) and in 21 counties in southern Georgia. Ms. Diaz replaces Rochelle Kentov, who retired effective the beginning of 2012.

NLRB issues complaint alleging unlawful discharges of union supporters at Miami casino

 The National Labor Relations Board has issued a complaint alleging that a Miami-area casino unlawfully discharged 10 key union supporters during an organizing campaign in November 2011.
The complaint also alleges that various managers and officers, including the company vice president, interrogated employees about their union sympathies, asked employees to inform on the union activities of coworkers and threatened employees with discharge. In the end, 10 employees who were members of the organizing committee were fired. No election has been held.

Pamela W. Scott appointed Resident Officer in NLRB’s Miami Resident Office

National Labor Relations Board Acting General Counsel Lafe Solomon announced the appointment of Pamela W. Scott as the Resident Officer of the NLRB’s Resident Office in Miami, Florida (Region 12).  In her new position, Ms. Scott will assist Acting Regional Director Margaret Diaz in the administration and enforcement of the National Labor Relations Act in Florida and southern Georgia.

Terry D. Combs is appointed Assistant to the Regional Director in NLRB's Tampa Regional Office

National Labor Relations Board Acting General Counsel Lafe Solomon announced the appointment of Terry D. Combs as the Assistant to the Regional Director of the NLRB’s Regional Office in Tampa, Florida (Region 12).  In his new position, Mr. Combs will assist Acting Regional Director Margaret Diaz in the administration and enforcement of the National Labor Relations Act in Florida and southern Georgia.

ALJ finds pattern of labor law violations at Puerto Rico hospital, orders employees reinstated

An NLRB administrative law judge has found that a Puerto Rico hospital repeatedly violated federal labor laws by changing conditions of work – including the elimination of an entire department - without bargaining with the union representing its employees.
In his Feb. 2 decision, Judge Geoffrey Carter ordered Quality Health Services of Puerto Rico, Inc., doing business as Hospital San Cristobal, to offer reinstatement to eight discharged respiratory therapists and stop subcontracting hospital work without bargaining with the union.

After remand by US appeals court, NLRB rules that display of inflatable rat balloon at secondary employer is permitted under labor laws

The National Labor Relations Board has ruled that a union practice of displaying a large inflatable rat balloon at a secondary employer’s premises to protest the labor practices of its non-union contractor is not coercive, and so does not violate U.S. labor law.
