Excluded: All other employees, other represented employees, exempt employees, managerial employees, confidential employees, physicians, registered nurses, employees of outside agencies supplying labor to the Employer, guards, and supervisors as defined by the National Labor Relations Act, as amended.

Unit Sought: PRESENT UNIT: Included: All full-time and regular part-time Technicians, House Managers, Director of Neighborhood Arts, Associate Director of Community Engagement, Drumming Instructor, Exhibitions and Operations Manager, Facilities Assistant Development, Communications Associate, and Presenting Associate employed by the Employer at its facility located at 80 Turk Street, San Francisco, California. Excluded: Managers, confidential employees, and supervisors as defined by the Act. However, The Producing Technical Director and Director of Programs are neither included in nor excluded from the bargaining unit covered by this Certification, inasmuch as the parties did not agree on their inclusion or exclusion but agreed to vote them subject to challenge. Their ballots were not determinative, and thus the parties’ disagreement over their inclusion or exclusion in the unit was not resolved.
