Unit Sought: Response to Item 5a: The Demand for Recognition (Exhibit B) lists the following “Included” and “Excluded” classifications: Employees Included: All full time and part time BMS Operators and Engineers. Employees Excluded: All other classifications, including but not limited to guards, managers, confidential employees and supervisors as defined by the Act. Included: BMS Engineers. Excluded: Despite the above, the RM Petitioner, Jones Lang LaSalle’s (the “Employer”), BMS Operators were previously certified into a bargaining unit. Therefore, the RC Petition filed by the International Union of Operating Engineers Stationary Engineers, Local 39, AFL-CIO (the “Union”) is deficient on its face and the Employer objects to their inclusion in the RC Petition. Further, titles to be excluded include Junior BMS Engineers, Junior BMS Technicians, and Control Systems Technicians. The Employer also contends that all other employees, including, but not limited to, guards, managers, confidential employees, and supervisors as defined by the Act must be excluded.
