Unit Sought: The Demand for Recognition (Exhibit B) seeks a single facility unit and lists the following “included” and “excluded” unit employees: Included: All full time and regular part time Welders employed by the Employer at its Hamburg, NY facility. Excluded: Machinists; testers; shipping and receiving employees; office clerical employees; weld inspectors, and all other employees, supervisors, managers, and guards as defined in the Act. Despite the above, the RM Petitioner contends that a unit consisting only of welders is not appropriate because other non-supervisor employees at this location share a community of interest with the Welders. Employer contends that the unit should be defined as follows: Included: All full time and regular part time Welders; Machinists; Shipping and Receiving employees; and Assembly/ Testing employees employed by the Employer at its Hamburg, NY facility. Excluded: All other employees, supervisors, managers, and guards as defined in the Act.
