Voting Unit (Unit A): Included: All full-time and regular part-time employees employed by the Employer at Healthcare sites located at 81 Junius Street, Brooklyn, NY 11212; 795 Lexington Avenue, Brooklyn, NY 11221; and 89-111 Porter Avenue, Brooklyn, NY 11237 with the professional titles of Nurse Practitioner, Registered Nurse, Pediatrician, and Physician. Excluded: All other employees including non-professional employees, employees with the titles of Nurse Manager, CASAC Opioid Use Disorder and Substance Use Disorder Coordinator (sometimes known as "CASAC Supervisor/Coordinator"), Dental Director, and Population Health and Outreach Manager (sometimes known as "Outreach Supervisor"), confidential employees, guards, managerial and supervisory employees as defined in the Act. The Employer will release bargaining unit employees with pay between the hours of 12:00 PM to 3:00 PM from the following Brooklyn, NY work locations: 795 Lexington Avenue and 89-111 Porter Avenue to allow sufficient time for them to be able to vote on the date of the election.

Voting Unit (Unit A): All full-time and regular part-time front house budtenders, cashiers, inventory, receptionist, delivery drivers, and shift leads employed by the Employer at its facility currently located at 4007 Norbeck Road, Rockville, Maryland but excluding all professional employees, managerial employees, guards, and supervisors as defined in the Act. Others permitted to vote: The parties have agreed that the following individuals may vote in the election but their ballots will be challenged since their eligibility has not been resolved: Assistant Managers. No decision has been made regarding whether the individuals in these classifications or groups are included in, or excluded from, the bargaining unit. The eligibility and inclusion of these individuals will be resolved, if necessary, following the election.

Voting Unit (Unit A): All full time and regular part time associates including optometric (OD) technicians, optometric coordinators, lab technicians, dispensers, eyewear specialists, third key retail, and lead receptionists, employed by the Employer at its store in Ashland Town Center, 500 Winchester Avenue, Suite 810, Ashland, Kentucky, but excluding all other employees, optometrists, retail supervisors, general managers, trainers, temporary associates, seasonal associates, guards and supervisors as defined in the National Labor Relations Act. Additional Language: There is a dispute as to whether the one lab supervisor should be included in the unit. The parties have reserved the right to challenge the eligibility of this employee and to resolve their status in a post-election proceeding, if necessary.
