The parties have agreed that Scale Attendants may vote in the election, but their ballots will be challenged since their eligibility has not been resolved. No decision has been made regarding whether the individuals in these classifications or groups are included in, or excluded from, the bargaining unit. The eligibility or inclusion of these individuals will be resolved, if necessary, following the election.
OTHERS PERMITTED TO VOTE: The parties have agreed that Per Diem* Registered Nurses may vote in the election in the professional unit and Per Diem* Patient Care Technicians (I/II/III) may vote in the election in the non-professional unit, but their ballot(s) will be challenged since the eligibility of their status has not been resolved.
No decision has been made regarding whether these classifications are included or excluded from the bargaining unit(s). The eligibility or inclusion of these employees will be resolved, including any community of interest issues, if necessary, following the election.
*The parties agree that the Davison-Paxon (Davison-Paxon Co., 185 NLRB 21 (1970)) standard to determine “regularity” of part-time employment shall be used in the instant case such that a part-time employee is eligible to vote if the employee, in one of the units above, has worked an average of four (4) hours or more per week during the 13 weeks immediately preceding the eligibility date for the election.
