At this time, no decision has been made regarding whether cashier supervisors, cook supervisors, deli supervisors, produce supervisors, meat department supervisors, and facilities managers are included in, or excluded from, the bargaining unit, and individuals in these classifications may vote subject to challenge. The eligibility or inclusion of these individuals will be resolved, if necessary, following the election.

EXCLUDED: All other employees, including employees in the operations department, sales training managers, operations and store managers, professional employees, guards and supervisors as defined in the Act. Inasmuch as the parties cannot agree as to whether or not any individual(s) employed in the classification of repair tech should be included in or excluded from the bargaining unit, any individual(s) employed in the repair tech classification will be permitted to vote subject to challenge.

Voting Unit (Unit A): Included: All full-time and regular part-time laborers performing site and ground improvement, utility, paving, and road building work and all related work including site preparation, mmilling, formsetting, and finishing of all surfaces, regarless of materials used, and who were employed by the Employer during the payroll period ending May 18, 2013. Excluded: All clerical employees, guards, professional employees and supervisors as defined in the Act. __________________ In addition to those eligible to vote under the Board's standard criteria, unit employees are eligible to vote if they have ben employed for 30 days or more within the 12 months ending May 18, 2013, or if they have had some employment in those 12 months and have been employed for 45 days or more within the 24 months period immediately ending May 18, 2013. Employees who have been terminated for cause or quit volunarily prior to a completion of the last job for which they were employed would not be eligible under this formula.
