Voting Unit (Unit A): Included: All full-time and regular part-time production and maintenance employees on all shifts who perform any type of work in the following functions: cake making, bread preparation, warehousing, driving and delivery, shiipping and receiving, packing, oven operations, food safety, and maintenance (including but not limited to repair, cleaning and washing), Excluded: All guards, office managers, executives, and supervisors as defined in the Act. [1] All full-time and regular part-time clerical and administrative employees who perform dual functions are neither included nor excluded from the unit, and will vote with the entire voting group, if those persons wish to do so, and may be subject to challenge by one of the parties at the election. If, after the final vote tabulation, those persons’ ballots are determinative of the outcome of the election, the parties agree that the appropriate unit placement for the said full-time and regular part-time dual function employees will be decided at a post-election proceeding before the Regional Director. If, after the final vote tabulation, those persons’ ballots are not determinative of the outcome of the election, the following will be appended to the Certification of Election: “Note, however that the full-time and regular part-time clerical and administrative dual function employees are neither included in nor excluded from the bargaining unit covered by this certification, inasmuch as the parties agreed to permit the said full-time and regular part-time dual function employees to vote subject to challenge.”

EXCLUDED: All other employees, including registered nurses, licensed practical nurses, managers, office clericals, guards and supervisors as defined in the Act.
