Voting Unit (Unit A): INCLUDED: All full-time and regular part-time coffee bar clerks employed by the Employer at Store #987. EXCLUDED: All other employees, coffee bar supervisors, demonstrators, confidential employees, guards, watchmen, professional employees, and supervisors as defined by the Act. The employees in the voting group will be asked two questions on their ballots: 1. Do you wish to be represented for purposes of collective bargaining by UNITED FOOD AND COMMERCIAL WORKERS UNION, LOCAL 1564, AFL-CIO?" The choices on the ballot will be "Yes" or "No". 2. Do you wish to be included with the Employer's other employees in the clerks unit already represented by UNITED FOOD AND COMMERCIAL WORKERS' UNION, LOCAL 1564, AFL-C10 at the Employer's Store #987, for the purpose of collective bargaining? The choices on the ballot will be "Yes" or "No". If a majority of valid ballots are not cast for representation, they will be taken to have indicated the employees' desire to remain unrepresented. If a majority of the voters in the voting group who cast valid ballots vote yes to the first question, indicating a desire to be represented by the Petitioner, and a majority of the valid votes are cast in the affirmative on the second question, the following employees would constitute a unit appropriate for collective bargaining: INCLUDED: All checking, stocking, receiving, produce, bakery sales, courtesy clerks, and coffee bar clerks employed by the Employer at Store #987.
