Voting Unit (Unit A): Included: All full-time and regular part-time fresh daily production employees employed by the Employer currently located at 7320 W 63rd St., Summit, Illinois. Excluded: All other employees, office clerical employees and guards, professional employees and supervisors, as defined by the Act. The election conducted on August 11, 2017 was set aside by mutual agreement of the Parties based upon alleged objectionable conduct of the Petitioner that interfered with the employees’ exercise of free and reasoned choice. Therefore, a new election will be held in accordance with the terms of this Notice of Election. All eligible voters should understand that the National Labor Relations Act, as amended, gives them the right to cast their ballots as they see fit and protects them in the exercise of this right, from interference by any of the Parties.

Freeway Drive, Columbus, MN; 720 3rd Avenue SW, Crookston, MN; 2225 255th Street, St. Cloud, MN; 1200 North Hwy 59, Marshall, MN; 6340 Hwy 63 S, Rochester, MN; 210 Garfield Avenue, Duluth, MN; or 8000 County Road 101, Shakopee, MN. Excluding: Office clerical employees, managerial employees, professional employees, sales persons, and guards and supervisors as defined in the Act, and all other employees. If a majority of valid ballots are cast for INTERNATIONAL UNION OF OPERATING ENGINEERS, LOCAL 49, they will be taken to have indicated the employees’ desire to be included in the existing bargaining unit defined by the ZIEGLER INC. COLLECTIVE BARGAINING AGREEMENT which is currently represented by INTERNATIONAL UNION OF OPERATING ENGINEERS, LOCAL 49. If a majority of valid ballots are not cast for representation, they will be taken to have indicated the employees’ desire to remain unrepresented.
