Excluded: All other employees, office and clerical employees, guards and supervisors as defined in the National Labor Relations Act OTHERS PERMITTED TO VOTE: At this time, no decision has been made regarding whether slot ambassadors (dual-rated) are included in, or excluded from, the bargaining unit, and individuals in those classifications may vote in the election but their ballots shall be challenged since their eligibility has not been resolved. Church Street, Santa Maria, CA 93454; 1325 E. Church Street, Santa Maria, CA 93454; and 715 Tank Farm Road, Suite B, San Luis Obispo, CA 93401. EXCLUDED: All other classifications, including but not limited to guards, managers, confidential employees and supervisors as defined by the Act, as amended. If a majority of the employees vote "Yes to the first question, indicating their desire to be included in a mixed unit of professional and non-professional employees, then their votes on the second question will be counted to decide the question concerning representation. If on the other hand, a majority of the employees voting do not vote "Yes to the first question, their votes on the second question will not be counted. If a majority of valid ballots are cast for Service Employees International Union, United Healthcare Workers — West (SEIU-UHW), they will be taken to have indicated the employees' desire to be included in the existing bargaining unit of professional and non-professional employees as set forth in the collective bargaining agreement between Dignity Health and Service Employees International Union, United Healthcare Workers — West (SEIU-UHW) that expires on April 30, 2023. If a majority of valid ballots are not cast for representation, they will be taken to have indicated the employees' desire to remain unrepresented.

Voting Unit (Unit A): Included: All production employees employed by the Employer at the Riverside Theater, including all employees working in the classifications of Stagehand (Hand), Audio-Visual (Audio), Rigger, and Lighting, and all other production-related workers. Excluded: Ticket takers, ushers, beverage service employees, office clerical employees, guards, professional employees and supervisors as defined by the Act. Those eligible to vote in the election are employees in the above unit who (a) were employed during the payroll period ending 8/29/2019, including employees who did not work during that period because they were ill, on vacation, or were temporarily laid off, and (b) worked at least two (2) events or five (5) work days for the Employer, regardless of the length of those days, during the year preceding the eligibility date for the election, or 15 days over the two (2) years preceding the eligibility date for the election.
