The parties’ contract further states that “[i]t is expressly agreed and understood between the parties that neither probationary employees as defined in this Agreement, nor persons enrolled or participating in pre-hire training programs offered by the Company, shall be considered employees under this Section.” The contract provides the following definition of probationary employees: “All employees newly hired, or rehired after termination of their seniority, shall be classified as probationary employees for a period of ninety (90) days from the date of hire or rehire.”
