About NLRB

Established in 1935, the National Labor Relations Board is an independent federal agency that protects employees, employers, and unions from unfair labor practices and protects the right of private sector employees to join together, with or without a union, to improve wages, benefits and working conditions. The NLRB conducts hundreds of workplace elections and investigates thousands of unfair labor practice charges each year. Region 16 serves areas in Arkansas and Texas from its Regional Office in Fort Worth and its Resident Offices in San Antonio and Houston.

Timothy L. Watson

Timothy L. Watson was appointed Regional Director of the NLRB’s Regional Office in Fort Worth, Texas (Region 16) in 2017. He began his career with the NLRB in 1988 as a Field Attorney in Region 16. In 1999, he was promoted to Deputy Regional Attorney in Region 16. In 2006, Mr. Watson was appointed the Regional Attorney in Region 16. In his capacity as Regional Attorney, Mr. Watson served as Region 16’s chief legal counsel.

NLRB To Seek Supreme Court Review in Noel Canning v. NLRB

The National Labor Relations Board has determined not to seek en banc rehearing in Noel Canning v. NLRB, in which the U.S. Court of Appeals for the DC Circuit held that the January 4, 2012 recess appointments of three members to the Board were invalid.  The Board, in consultation with the Department of Justice, intends to file a petition for certiorari with the United States Supreme Court for review of that decision.  The petition for certiorari is due on April 25, 2013. 

Board finds Houston engineering firm unlawfully fired employee for discussing salaries with coworkers

The National Labor Relations Board has found that a Texas engineering firm unlawfully fired an employee for discussing salary information with co-workers, and ordered the company to offer reinstatement and to pay back wages for the time out of work.
Under the Board Order, which issued February 8, Houston-based Jones & Carter, Inc. also must rescind its policy of forbidding employee discussion of salaries. The National Labor Relations Act protects the rights of workers to discuss their terms and conditions of employment, including wages.

Texas manufacturer to pay more than $58,000 and reinstate workers in NLRB settlement

Baked-goods manufacturer Sterling Foods, LLC, has agreed to pay more than $58,000 in back pay and interest to six employees who were discharged in the fall of 2011 following a union organizing campaign.  Three of the employees have also accepted offers of reinstatement to their previous jobs. 
The United Food and Commercial Workers Local Union No. 455 filed charges alleging the employer engaged in multiple unfair labor practices during and after the union’s attempt to organize about 500 employees at the San Antonio, Texas facility. An election petition was not filed.

Settlement distributes more than $300,000 to unlawfully discharged workers in Texas

In a settlement with the National Labor Relations Board, a Texas scaffolding company has agreed to pay $323,116 in backpay, per diem and interest to 73 former employees who were discharged in violation of federal labor law.
The agreement, signed February 3, also requires Atlantic Scaffolding Company to expunge its records of the discharges and send written notification of the action to the employees.

Board finds Texas scaffolding company unlawfully fired striking workers

The National Labor Relations Board has found that a Texas scaffolding contractor unlawfully discharged 77 employees in retaliation for their participation in a peaceful work stoppage. 
In 2008, Atlantic Scaffolding Company contracted with ExxonMobil Oil Refining and Supply Corporation to provide scaffolding work during a “turnaround” at an oil refinery in Beaumont, Texas.  During a turnaround, processing units are shut down to undergo inspection and maintenance. 

Employees reject union in rerun election at Texas fire sprinkler company

Employees at a Texas company that installs and repairs fire sprinkler systems rejected union representation in an election that was rerun pursuant to a settlement with the National Labor Relations Board.
Results of the late-February election at Waco-based Fire & Access Control Systems.com, doing business as Jerry Dickerson Automatic Fire Protection, were  9-to-2 against joining the Road Sprinkler Fitters Local Union No. 669, U.A., AFL-CIO, with six challenged ballots. Results were certified by the NLRB regional office last week.
