Region 28-Phoenix Wins Injunction Requiring Lucid USA Inc. to Reinstate Employees

On September 13, 2024, United States District Judge Diane J. Humetewa of the District Court of Arizona issued an injunction order requiring Casa Grande, Arizona-based electric vehicle manufacturer Lucid USA Incorporated to offer interim reinstatement to two employees, cease and desist from violating labor law, physically post copies of the Court’s Order, and convene one or more mandatory meetings for employees on working time during which the Injunction Order must be read in English and any other language that employees may need. The Court’s Order provides this relief pending a final decision by the National Labor Relations Board on the underlying administrative complaint.

The injunction was issued based on a petition for temporary injunctive relief filed by Region 28-Phoenix Regional Director Cornele Overstreet under Section 10(j) of the National Labor Relations Act (NLRA), which authorizes the Board to seek injunctions against employers and unions in federal district courts to stop unfair labor practices and ensure that employees’ rights will be adequately protected from remedial failure due to the passage of time. The petition, filed in June 2024, alleged that Lucid engaged in unlawful activity, including that Lucid discharged two employees for union organizing activity, surveilled workers’ union activity, and made threats against engaging in union activity. 

“Workers have the right to organize for better pay and working conditions at their workplace, free from employer intimidation,” said Regional Director Overstreet. “I’m proud of the Region 28 staff for their dedication to the Act, including obtaining strong injunctive relief to restore and protect that right for Lucid’s employees.”

Region 28 serves areas in Arizona, Nevada, New Mexico, and Texas from its Regional Office in Phoenix and its Resident Offices in Albuquerque and Las Vegas.
