Region 22 Issues An Order Consolidating Cases, Consolidated Complaint and Notice of Hearing Against Local 560, International Brotherhood of Teamsters

Region 22 Director J. Michael Lightner issued an Order Consolidating Cases, Consolidated Complaint and Notice of Hearing on April 29, 2013 against Local 560, International Brotherhood of Teamsters.  The charges in this matter were filed by County Concrete Corporation.  Director Lightner had previously approved a Settlement Agreement agreed to by the Union in which the Union agreed to take certain actions to remedy the unfair labor practices alleged in a prior Complaint.  The Union failed to comply with the terms of the Settlement and County Concrete filed a subsequent charge on February 28, 2013 alleging that the Union engaged in additional unfair labor practices in violation of the Act.  Accordingly, pursuant to the terms of the Settlement, the instant Complaint issued.  The Complaint alleges that the Union violated Sections 8(e), 8(b)(4)(ii)(A) & (B) of the Act by entering into, maintaining, enforcing or giving effect to a Project Labor Agreement with employers whereby such employers agree to cease and refrain from doing business with County Concrete and by threatening, restraining or coercing employers in order to force the employers to enter into an agreement that is prohibited by Section 8(e) of the Act or to stop employers from doing business with County Concrete Corp.  A hearing before an Administrative Law Judge regarding these matters is scheduled to take place in the Region 22 office on May 29, 2013.
