The NLRB reopened from shutdown status on November 13, 2025. Due dates to file or serve most documents were tolled during the period of the shutdown, although due dates cannot be tolled for filing and service of unfair labor practice charges, applications for awards of fees and other expenses under the Equal Access to Justice Act, and certain representation petitions. For documents where tolling applies, the terms are that for each day on which the Agency’s offices were closed for all or any portion of the day, one day is added to the time for filing or service of the document. If the new due date falls on a weekend or holiday, the new due date will be moved to the next business day. For example, if the original due date was October 7, 2025 and the shutdown lasted 43 days, the revised due date is November 19, 2025. See chart for revised due dates.

Jessica Rutter Appointed Deputy General Counsel

Today, the National Labor Relations Board General Counsel Jennifer A. Abruzzo appointed Jessica Rutter as Deputy General Counsel.  

Ms. Rutter has previously served as the Associate General Counsel in the Office of the General Counsel since August 2021. She first joined the Agency as a summer law clerk in Region 28-Phoenix. In August 2013 she was selected as an honors attorney in the General Counsel-side headquarters program where she rotated through the Division of Advice, the Contempt Compliance & Special Litigation Branch, Region 5-Washington Resident Office, and the Office of Appeals. In August 2015, she joined the Division of Advice, where she worked in the Regional Advice Branch and Injunction Litigation Branch, and served on committees relating to protecting immigrant workers and obtaining all appropriate remedial relief.  Ms. Rutter also worked for unions and other workers’ rights organizations in a variety of capacities. She graduated with a bachelor’s degree from Duke University and a J.D. from the University of California Los Angeles.

The NLRB conducts hundreds of workplace elections and investigates thousands of unfair labor practice charges each year.
