Chief Administrative Law Judge Robert A. Giannasi denied the Respondent’s Motion for Summary Judgment, finding that the Respondent failed to establish that there were no genuine issues of material fact and that it was entitled to judgment as a matter of law. Charge filed by International Brotherhood of Teamsters, Local 969. Judge Giannasi decided the motion pursuant to 29 C.F.R. 102.179 in the absence of a quorum.

Appellate Court Decisions
Nexstar Media Inc., Authorized to Operate Television Station WROC-TV, Board No. 03-CA-332930 (reported at 373 NLRB No. 88) (2d Cir. April 3, 2025).
In a published order, the Court denied Nexstar’s Motion to Dismiss the Board’s application for enforcement. In the underlying decision, the Board (then-Chairman McFerran and Members Prouty and Wilcox) granted the General Counsel’s Motion for Summary Judgment and found that Nexstar violated Section 8(a)(5) and (1) by refusing to recognize and bargain with the duly elected representative of an appropriate unit of Nexstar employees. The Board also severed and retained for further consideration the General Counsel’s request that the Board order an additional remedy for the Employer’s refusal to bargain that would compensate employees for the value of that lost opportunity.
Before the Court, and prior to briefing, Nexstar filed a Motion to Dismiss the enforcement proceeding based on its claim that the Board’s severance of the remedial issue had rendered the Board’s order non-final and thus not within the Court’s jurisdiction to review. In denying the motion, the Court applied the standard for finality set forth by the Supreme Court in Bennett v. Spear, 520 U.S. 154, 178 (1997): “First, the action must mark the consummation of the agency’s decisionmaking process—it must not be of a merely tentative or interlocutory nature,” and “second, the action must be one by which rights or obligations have been determined, or from which legal consequences will flow.” The Court held both prongs were met because the bargaining order was the consummation of the Board’s decisionmaking process, and carried the legal consequence of requiring Nexstar to recognize and bargain with the Union. Further, the Court explained that any subsequent Board proceeding on the severed remedial issue would have no impact on the bargaining order.
Accordingly, in this precedential order, the Court joined four of its sister circuits to hold that the Board’s severance of a discrete remedial issue does not necessarily render the order non-final. See NLRB v. ArrMaz Prods. Inc., 123 F.4th 1295 (11th Cir. 2024); NLRB v. United Scrap Metal PA, LLC, 116 F.4th 194 (3d Cir. 2024); NLRB v. Siren Retail Corp., 99 F.4th 1118 (9th Cir. 2024); Longmont United Hosp. v. NLRB, 70 F.4th 573 (D.C. Cir. 2023).
