San Francisco, CA – Region 20 of the National Labor Relations Board (NLRB) completed a vote count on September 9, 2021 in a union election involving employees at Dandelion Chocolate, Inc. choosing whether or not to be represented by the International Longshore and Warehouse Union. After counting the ballots earlier this year, the election stood at 18 votes for the Petitioner (ILWU) and 16 against the Petitioner with nine challenged ballots remaining. Regional Director Jill Coffman recently ruled that five of the challenged ballots would be opened and counted, but the remaining four ballots would not. Neither party requested Board review of her Decision, and the resultant Revised Tally of Ballots shows the following uncertified results:

Approximate number of eligible voters

43

Number of void ballots

0

Number of votes cast for the Petitioner, the ILWU

20

Number of votes cast against participating labor organization

19

Number of valid votes counted

39

Number of valid votes counted plus challenged ballots

39

Number of sustained challenges (voters ineligible)

4

A majority of the valid votes counted plus challenged ballots has been cast for the Petitioner, the International Longshore and Warehouse Union.

The ballot count was conducted by NLRB Region 20 employees at the San Francisco Regional Office. The results of this count will not be certified until the Region processes any objections that might be filed by the parties contesting the revised tally of ballots.

Established in 1935, the National Labor Relations Board is an independent federal agency that protects employees, employers, and unions from unfair labor practices and protects the right of private sector employees to join together, with or without a union, to improve wages, benefits and working conditions. The NLRB conducts hundreds of workplace elections and investigates thousands of unfair labor practice charges each year. Region 20 serves areas in California, Hawaii, and Northern Mariana Islands from its Regional Office in San Francisco and Subregional Office in Honolulu.
