HealthAlliance Hospital Mary’s Avenue Campus (03-CA-262661) Kingston, NY, September 10, 2021.  The Board denied the Respondent’s Motion to Dismiss the Complaint and Defer to Arbitration, and also denied the Respondent’s alternative request to dismiss the complaint for failure to state a claim.  The denial was without prejudice to the Respondent’s right to renew its deferral arguments to the Administrative Law Judge, after presenting evidence, and to raise the deferral issue before the Board on exceptions, if appropriate.  Charge filed by the New York State Nurses Association.  Chairman McFerran and Members Kaplan and Ring participated.

Littlejohn Electrical Solutions, LLC (16-CA-214170) Denton, TX, September 10, 2021.  The Board denied petitions to revoke three investigative subpoenas duces tecum, as the subpoenas sought information relevant to the matter under investigation and described with sufficient particularity the evidence sought, and the petitioners failed to establish any other legal basis for revoking the subpoenas.  Charge filed by International Brotherhood of Electrical Workers, Local Union No. 20.  Chairman McFerran and Members Kaplan and Ring participated.
