Summary of NLRB Decisions for Week of October 5 - 9, 2026

The Summary of NLRB Decisions is provided for informational purposes only and is not intended to substitute for the opinions of the NLRB.  Inquiries should be directed to the Office of the Executive Secretary at 202‑273‑1940.

Summarized Board Decisions

B.N.F. Painting, LLC (09-CA-318278; 375 NLRB No. 60)  Cincinnati, OH, October 8, 2026.

The Board dismissed the Respondent’s exceptions that the Administrative Law Judge improperly: (1) denied it due process by granting the General Counsel’s motion to amend the complaint at the start of the hearing; and (2) failed to grant its motion to dismiss at the close of the General Counsel’s case-in-chief after the General Counsel did not introduce a copy of a disputed work rule as part of her case-in-chief.  The Board found that the judge did not abuse her discretion in granting the motion to amend and permissibly declined to render a judgment on the motion to dismiss until the close of the evidence.  In concurrence, Member Prouty wrote separately to note the more limited grounds on which he relied.

Charge filed by an individual.  Administrative Law Judge Kimberly R. Sorg-Graves issued her decision on February 17, 2026.  Members Prouty, Mayer, and Macy participated.
