Summarized Board Decisions

Essentia Health  (18-RC-330714; 374 NLRB No. 140)  Duluth, MN, July 15, 2026. 

The Board (Chairman Murphy and Member Mayer; Member Prouty, dissenting in part) granted the Employer’s Request for Review of the Regional Director’s Decision and Direction of Election as it raised substantial issues warranting review.  In addition, the Board issued a Notice and Invitation to File Briefs, inviting the parties and interested amici to address the following questions: (1) Does the Board’s Health Care Rule govern unit composition in cases where a petitioned-for multi-facility unit includes both acute-care hospitals and non-acute-care facilities? (2) If not, what unit composition standard should apply? Should the Board apply the standard articulated in American Steel, or some other standard? 

Member Prouty, dissenting in part, would not have granted review, but nonetheless joined the majority in soliciting briefs. 

Petitioner—Minnesota Nurses Association. Chairman Murphy and Members Prouty and Mayer participated.

The Board denied the Employer’s Request for Review of the Regional Director’s determination to hold the petition in abeyance as it raised no substantial issues warranting review.

R Cases

Start Small. Think Big., Inc. (02-RC-317333)  New York, NY, July 13, 2026. The Board (Chairman Murphy and Member Prouty; Member Mayer, dissenting) denied the Employer’s Request for Review of the Regional Director’s Decision and Direction of Election. In denying review of the Regional Director’s finding that the Employer’s Senior Finance Program Manager is not a statutory supervisor on the basis of hiring, the majority did not reach the question of whether the Senior Finance Program Manager possesses the authority to effectively recommend hire, but rather found that the Employer had not met its burden to establish that the Senior Finance Program Manager uses independent judgment when recommending applicants. Member Mayer, dissenting, would have granted review. Petitioner—Start Small Collective Bargaining Unit, Local 3202. Chairman Murphy and Members Prouty and Mayer participated.

Hiller, LLC   (10-RC-345700)  Bowling Green, KY, July 14, 2026.  The Board denied the Employer’s Request for Review of the Regional Director’s Decision on Exceptions to the Hearing Officer’s Report and Order on Challenged Ballot as it raised no substantial issues warranting review.  Petitioner—UA Local 502 Plumbers Pipe Fitters and Services Technicians.  Chairman Murphy and Members Prouty and Mayer participated.

Starbucks Corporation   (22-RD-369759)  Summit, NJ, July 14, 2026. The Board denied the Petitioner's Request for Review of the Regional Director's letter blocking the petition as it raised no substantial issues warranting review.  Petitioner—an individual.  Union—Workers United.  Chairman Murphy and Members Prouty and Mayer participated.

SWCA, Inc. d/b/a SWCA Environmental Consultants  (27-RM-359491)  Broomfield, CO, July 16, 2026.  The Board denied the Employer’s Request for Review of the Regional Director’s Decision and Direction of Election and Decision and Certification of Representative as it raised no substantial issues warranting review.  Member Mayer agreed with his colleagues that the Regional Director did not err in not precluding the Union from litigating the issues raised in its Statement of Position (SOP) based on its failure to a timely SOP in a prior case dismissed after the Union disclaimed interest.  Member Mayer stated that the policies of the Act would be better served by amending the Board’s rules to allow Regional Directors some discretion to accept late-filed SOPs in cases where no prejudice has been shown. Petitioner—International Brotherhood of Teamsters Local 455.  Chairman Murphy and Members Prouty and Mayer participated.

Mercedes-Benz of Manhattan, Inc.  (02-RD-367095)  New York, NY, July 16, 2026. The Board denied the Petitioner’s and the Employer’s Requests for Review of the Acting Regional Director’s determination to hold the petition in abeyance as they raised no substantial issues warranting review. Petitioner–an individual. Union—United Auto Workers Local 259.  Chairman Murphy and Members Prouty and Mayer participated.

We Care Skilled Nursing Fremont, California  (32-UC-363158)  Fremont, CA, July 16, 2026. The Board denied the Employer's Request for Review of the Regional Director's Decision dismissing the petition as it raised no substantial issues warranting review. Union—Service Employees International Union, Local 2015. Chairman Murphy and Members Prouty and Mayer participated.

JSK Parsippany, LLC d/b/a Fairfield Inn & Suites by Marriott and Fairfield Parsippany, LLC d/b/a Fairfield Inn & Suites by Marriott as its Successor  (22–CA–305280, et al.)  Parsippany, NJ, July 13, 2026.  The Board denied the General Counsel’s Motion for Clarification of the Board’s Decision and Order reported at 374 NLRB No. 124 (2026).  The Board found that the General Counsel had not demonstrated that further clarification was warranted.  Charges filed by Hotel and Gaming Trades Council, AFL-CIO.  Chairman Murphy and Members Prouty and Mayer participated.
