Summarized Board Decisions

LIOX Cleaners, Inc.  (02-CA-271871 and 02-CA-274017; 371 NLRB No. 64)  New York, NY, February 8, 2022.

The Board granted the General Counsel’s Motion for Default Judgment based on the Respondent’s failure to file an answer to the complaint.  The Board found that the Respondent violated Section 8(a)(1) by threatening that the unit employees’ facility would close and they would lose their jobs if they supported the Union, by more closely supervising unit employees and imposing written performance reviews on them because of their union support, and by issuing written warnings to two union supporters and then discharging one of them.  The Board also found that the Respondent violated Section 8(a)(5), (3), and (1) by transferring unit work to a nonunion facility, laying off unit employees, and refusing to recall them, all due to unit employees’ support for the Union and without notice to, or bargaining with, the Union.

Charges filed by an individual.  Chairman McFerran and Members Kaplan and Ring participated.
