Summary of NLRB Decisions for Week of August 24 - 28, 2026

Summarized Board Decisions

American Backflow & Fire Prevention, Inc.  (13-CA-385856, et al.; 375 NLRB No. 31)  Wauconda, IL, August 25, 2026.

The Board adopted the Administrative Law Judge’s conclusions that the Respondent violated: Section 8(a)(1) by displaying and maintaining a sign prohibiting unions on the door of the main entrance to its facility; Section 8(a)(3) and (1) by refusing to consider for hire three applicants; refusing to hire one applicant; changing its website to indicate that it was not hiring employees for bargaining-unit positions; and changing its hiring practice of accepting and maintaining hard-copy paper applications for bargaining-unit employees; and Section 8(a)(5) and (1) by unilaterally discontinuing its past practice of conducting annual performance appraisals and its past practice of issuing performance-based pay increases of between $1 and $3 by about March of each year; transferring bargaining-unit work to nonunit employees, supervisors, and/or managers; changing its past practice of granting wage increases of $5 to bargaining-unit employees for obtaining trade certifications or licenses; and withdrawing recognition from, and failing and refusing to bargain with, the Unions as the exclusive collective-bargaining representatives of the unit employees.

The Board ordered the Respondent to cease and desist from taking these actions, offer employment to one applicant, remove the unlawful sign, rescind the unlawful unilateral changes, recognize and bargain with the Unions, comply with a bargaining schedule, and make employees whole.

The Board also ordered that the Respondent's representative be referred for investigation under Section 102.177(d) and (e)(1) of the Board's Rules and Regulations to determine whether the representative engaged in misconduct that may be grounds for discipline.

SKBAR, LLC d/b/a Smoothie King  (10-CA-367860; 375 NLRB No. 29)  Statesboro, GA, August 25, 2026.

The Board granted the General Counsel’s Motion for Default Judgment based on the Respondent’s failure to file an answer to the complaint.  The Board found that the Respondent violated Section 8(a)(1) by discharging an employee because he engaged in protected concerted activities; threatening to discharge and remove employees from meetings if they engaging in protected concerted activity; maintaining and telling employees about a rule prohibiting employees from discussing pay with coworkers; and telling employees not to talk about pay with their coworkers. 

Charge filed by an individual.  Chairman Murphy and Members Prouty and Mayer participated.

Republic National Distributing Company LLC  (16-RD-327720; 375 NLRB No. 30)  Houston, TX, August 26, 2026. 

The Board granted the Employer’s Request for Review of the Regional Director’s Order Dismissing Petition as it raised substantial issues warranting review.  On review, the Board         (Chairman Murphy and Member Mayer; Member Prouty, dissenting) reversed the Regional Director, finding that the collective-bargaining agreement between the parties did not include a clear effective date, and therefore, that the contract did not bar the decertification petition. Member Prouty, dissenting, would have found that the contract barred the petition. 

Petitioner—an individual. Union—Teamsters Local Union No. 988. Chairman Murphy and Members Prouty and Mayer participated.

Altorfer Inc.  (25-CA-327736; 375 NLRB No. 32)  East Peoria, IL, August 27, 2026.

The Board adopted the Administrative Law Judge’s dismissal of the allegation that the Respondent violated Section 8(a)(3) and (1) by terminating a probationary employee.  In the absence of exceptions, the Board adopted the judge’s finding that the Respondent violated Section 8(a)(1) by unlawfully interrogating the employee.  

Charge filed by International Union of Operating Engineers, Local 150, a/w International Union of Operating Engineers.  Administrative Law Judge Geoffrey Carter issued his decision on August 5, 2025.  Chairman Murphy and Members Prouty and Mayer participated.

R Cases

Wyndham Vacation Ownership, Inc.  (05-RD-385547)  Oxon Hill, MD, August 24, 2026.  The Board denied the Employer’s Request for Review of the Regional Director’s Order Granting the Union’s Request to Block as it raised no substantial issues warranting review. Petitioner—an individual.  Union—International Union of Operating Engineers, Local 99.  Chairman Murphy and Members Prouty and Mayer participated.

Stericycle, Inc.  (19-RC-390296)  Kent, WA, August 24, 2026.  The Board denied the Employer’s Request for Review of the Regional Director’s Decision and Direction of Election as it raised no substantial issues warranting review. The Board found that the Regional Director did not abuse his discretion in directing a mail ballot election. Member Prouty stated that he would support revisiting the Board’s decision in San Diego Gas & Electric, 325 NLRB 1143 (1998) and that he favors a standard more weighted towards the acceptance of mail balloting.  Petitioner—General Teamsters Local 174 a/w International Brotherhood of Teamsters.  Chairman Murphy and Members Prouty and Mayer participated.

Westport Axle Co., LLC   (10-RC-389226)  Cloverdale, VA, August 25, 2026. The Board granted the Employer's Request for a Stay of the Hearing on Objections pending its decision on the Employer's Request for Review of the Regional Director’s Order Directing Hearing and Effective Denial of Employer’s Motion for a Bill of Particulars. Petitioner—International Brotherhood of Teamsters Local 171.  Chairman Murphy and Members Prouty and Mayer participated.

Nexstar Media Group, Inc.  (14-RM-374657)  St. Louis, MO,  August 25, 2026.  The Board denied the Employer’s Request for Review of the Regional Director’s Decision on Objections and Certification of Representative as it raised no substantial issues warranting review.  The Regional Director found that Employer’s objections, which alleged that the Union unconditionally offered to waive initiation fees, did not constitute evidence that, if introduced at a hearing, is sufficient to warrant setting aside the election.  Union—International Brotherhood of Electrical Workers, Local  No. 4.  Chairman Murphy and Members Prouty and Mayer participated. 

C Cases

Northeastern University   (01-RC-313126 and 01-CA-329551 )  Boston, MA, August 26, 2026. Upon remand from the First Circuit, the Board vacated its prior decision finding that the Employer violated Section 8(a)(5) and (1) by refusing to bargain with the Union and dismissed the unfair labor practice complaint against the Employer. The Board reopened the underlying representation case and issued a Notice to Show Cause as to why the Board should not grant the Employer’s Motion to Dismiss the petition in light of its assertion that the Union has disclaimed interest in representing the unit at issue in the proceeding. Petitioner—American Coalition of Public Safety. Chairman Murphy and Members Prouty and Mayer participated.
