Unit Description: EXHIBIT A ARTICLE 1 •PARTIES TO THE AGREEMENT, RECOGNITION AND SCOPE Section 1.3 - Recognition/Definition of Bargaining Unit A. The Employer herewith recognizes the Union as the sole and exclusive collective bargaining agent with respect to rates of pay, hours and other terms and conditions of employment for the bargaining unit of employees employed by the Employer at Its Facilities covering Locals 70, 174, 495, 763 and 848 and at any other facility located within the geographical area covered by this Agreement to which bargaining unit work may hereinafter be transferred or relocated. B. Excluded from the bargaining unit covered by this Agreement are all other employees, including, but not limited to, employees in the positions of supervisors, guards and managers as defined In the National Labor Relations Act, as amended .(hereinafter called the "Act"). 8 EXHIBIT B Section 1.3 – Recognition/Definition of Bargaining Unit A. The Employer herewith recognizes the Union as the sole and exclusive collective bargaining agent with respect to rates of pay, hours and other terms and condition of employment for the bargaining unit of employees employed by the Employer at its facilities covering Locals 174 and 763. B. Excluded from the bargaining unit covered by this Agreement are all other employees, including, but not limited to, employees in the positions of supervisors, guards and managers as defined in the National Labor Relations Act, as amended. EXHIBIT C ARTICLE 3 - SENIORITY RIGHTS AND BIDDING 3.2 The current regular full time employees on the seniority list as of the ratification of this Agreement shall have a (40) hour guarantee of work or pay for the life of this Agreement For all other employees hired after the ratification the following bids and guarantees shall apply: I. There shall be a minimum of twelve (12) bid yard positions with a forty (40) hour weekly guarantee. 2. There shall be a minimum of five (5) bid dock positions with a forty (40) hour weekly guarantee. 3. There shall be a minimum of eleven (11) bid hostling positions with a forty (40) hour weekly guarantee. 4. There shall be a minimum of two (2) bid lead positions with a forty (40) hour weekly guarantee. 5. There shall be a minimum of one (1) bid grmmdman position with a forty (40) hour weekly guarantee. 6. There shall be a minimum of one (I) bid packer position with a forty (40) hour weekly guarantee. 7. There shall be a minimwn of eighty percent (80%) bid street positions with a forty ( 40) hour weekly guarantee. Tn the event of a loss of a major account resulting in the possible reduction of any of the bid positions listed in 1 through 7 above, the Company and the Union will meet and discuss such loss and the effect on the bargaining unit. The burden of proof shall be entirely on the Company to prove the loss of such account is the need for any layoff. Any dispute between the parties shall be mitigated through Article 18 of the Grievance Procedure in the Master Agreement. 9
