The parties agree Kitchen Managers are not managers under the meaning of the National Labor Relations Act in that they do not have the authority to formulate, determine, or effectuate employer policies by expressing and making operative the decisions of their employer and they do not have discretion in the performance of their jobs independent of their employer’s established policies. The parties agree that employees in the listed classification are eligible to vote in the election.
