Excluded: All office clerical employees, front office employees, desk clerks, casual or intermittently employed people, and guards and supervisors as defined in the National Labor Relations Act, as amended. If a majority of valid ballots are cast for Petitioner, they will be taken to have indicated the employees' desire to be included in the existing bargaining unit currently represented by UNITE HERE Local 17, as described in its current collective bargaining agreement with the Employer effective June 1, 2017, through May 31, 2020, which covers the Employer’s only facility in Minneapolis, Minnesota. If a majority of valid ballots are not cast for representation, they will be taken to have indicated the employees’ desire to remain unrepresented.
