Unit Description: Unit Involved: The present bargaining unit includes all full-time and regular part-time production and maintenance employees, including production, maintenance, PMHA, warehouse, environmental, E and I, PASC and IA Technicians, chemical assistants, senior laboratory and laboratory technicians, materials control coordinator, transportation services coordinator, production services coordinator, operational engineering assistants and maintenance engineering assistants employed by Chemutra at its Morgantown, West Virginia facility; and excudes the drafting specialist, office clerical employees (including the purchasing coordinator and assistant buyer), guards, professional employees and supervisors as defined in the Act. Proposed Clarification: Bases on the recent lines of cases interpreting the Kentucky River line of cases (including but not limited to Oakwood Healthcare, Inc., 348 NLRB No. 37 (Sept. 29, 2006), the Board has made it clear that employees in positions such as the operational engineering assistants (Also knows as "OEAs") and the mechanical engineering assistants (also knows as "MEAs") at the Company's Morgantown, West Virginia facility are statutory supervisors and thus should be excluded from the bargaining unit certified on May 16, 2006. Accordingly, Chemtura submits that the proper bargaining unit, as clarified, should included all full-time and regular part-time production and maintenance employees, including production, maintenance, PMHA, warehouse, environmental, E and I, PASC and IA technicians, chemical assistants, senior laboratory and laboratory technicians, and the materials control coordinator, transportation services coordinator, and production services coordinator, employed by Chemtura at its Morgantown, West Virginia facility, and exclude the operational engineering assistants, maintenance engineering assistants, drafting specialist, office clerical employees (including the purchasing coordinator and assistant buyer), guards, profession
