Gardner was appointed an NLRB judge in November 2016.  He previously served 18 months as an ALJ with the Social Security Administration.  Before his appointment as a Social Security judge, Judge Gardner was in the private practice of law representing clients in labor and employment matters.  Earlier, he spent 14 years as a trial attorney with the Board’s regional office in Newark, New Jersey.  He has also taught as an adjunct professor at New York Law School.  Judge Gardner received his B.A. degree with honors from Rutgers College, and was named to Phi Beta Kappa.  He went on to get his J.D. from Rutgers Law School, where he received a “Legal Writing Distinction” award, as well as a Pro Bono Service Award.  After law school, and prior to joining the Board in Newark, he clerked for Judge Sylvia B. Pressler of the Superior Court of New Jersey, Appellate Division, and was an associate in private practice, where he handled labor, employment and commercial litigation.
