Effective October 21, 2019, parties to unfair labor practice or representation cases processed in NLRB Regional Offices must submit all written statements, correspondence, position statements, documentary or any other evidence through the Agency’s electronic filing system (E-Filing).

The National Labor Relations Board is engaged in rulemaking to establish the standard for determining whether students who perform services at a private college or university in connection with their studies are “employees” within the meaning of Section 2(3) of the National Labor Relations Act (29 U.S.C. § 152(3)).

The Notice of Proposed Rulemaking (NPRM) was published in the Federal Register on September 23. 2019, and can be found here

Comments may be submitted through http://regulations.gov or by mail or hand delivery to Roxanne Rothschild, Executive Secretary, National Labor Relations Board, 1015 Half Street S.E., Washington, D.C. 20570-0001.  The rulemaking docket RIN is 3142-AA15, and the Federal Register Document Number is 2019-20510.  The period for submitting comments has been extended.  Comments must be submitted by 11:59 pm on or before Monday, December 16, 2019.  Comments replying to comments submitted during the initial comment period must be received by the Board on or before Monday, December 30, 2019.
