Unit Sought: Included: All Baristas and Shift Supervisors employed by the Employer at the store located at: 1742 Fremont Blvd, Seaside, CA 93955. Excluded: All Store Managers, Assistant Store Managers, office clericals, guards and supervisors as defined by the Act

Unit Sought: INCLUDED: the Employer recognizes the Union as the sole and exclusive collective bargaining representative with respect to wages, hours and other terms and conditions of employment, as defined by the National Labor Relations Act (hereinafter also "the Act"), for a bargaining unit which INCLUDES all full-time and regular part-time driver and driver installers employed by the employer at or from its facility located at 650 Brennan Street, San Jose, California, EXCLUDED: all warehouse workers, confidential employees, office clerical employees, guards, and supervisors as defined in the Act, and all other employees employed by the Employer. The bargaining unit also excludes any and all individuals employed by a third party employer but who are assigned to work as drivers for the Employer, even if one or more of those drivers is determined to be jointly employed by the third party and the Employer.
