Region 22 Director J. Michael Lightner issued a Complaint and Notice of Hearing against Environmental Contractors, Inc and Kielczewski Corp on July 31, 2013 alleging, among other things, that the two entities are alter egos and a single employer. The Employers have an office and place of business in West Orange, New Jersey and are contractors in the construction industry doing residential and commercial demolition, asbestos removal, mold removal and lead removal. The New Jersey Building Construction Laborers District Council is an organization composed of various employers in the construction industry, one purpose of which is to represent its employer-members in negotiating and administering collective-bargaining agreements with the Union. The Union involved in this matter is Local 78, Laborers International Union of North America. The Complaint alleges that the Employer gave timely notice that it was revoking its authorization to the Association to negotiate on its behalf, and terminating the collective bargaining agreement. The Union thereafter requested that the Employer recognize it as the exclusive collective-bargaining representative of the Unit and bargain collectively with the Union as the exclusive collective-bargaining representative of the Unit, but the Employer failed and refused to do so. The Complaint further alleges that the Employer made changes to wages and benefits paid to Unit employees, in violation of Section 8(a)(5) of the Act. A hearing on these matters is scheduled to take place before an Administrative Law Judge on September 24, 2013 in the Region 22 office.
