Concurring and dissenting statements on representation case rule published

On December 22, 2011, the National Labor Relations Board issued a final rule amending its procedures in representation cases. In ordering publication of the rule, the Board also provided for the subsequent publication of separate concurring and dissenting statements concerning the rule. Those statements, the concurring statement of Chairman Mark Gaston Pearce and the dissenting statement of Member Brian E. Hayes, are now available for public inspection at the Federal Register.

The new procedures, which consolidate some legal appeals and limit the introduction of evidence at hearings to issues that directly address the question of whether an election should be held, will apply to all election petitions filed on or after Monday, April 30.
